Terms of Use
Last updated:
These terms cover Waylit’s app, account services and website, provided by Vladyslav Shynder, an individual trading as Waylit, based in the United Kingdom (“we”). Use the service only if you agree to these terms and are at least 16 (the 16+ App Store tier).
Your licence and Apple’s EULA
The iOS app is licensed, not sold. For downloads through the App Store, Apple’s Standard Licensed Application End User License Agreement governs the app licence unless a custom EULA is expressly supplied in the App Store. These terms supplement that licence for Waylit’s services and do not replace it or reduce your rights under it.
Your licence is personal and non-transferable, for Apple-branded devices you own or control, subject to Apple’s usage rules, including permitted Family Sharing and volume purchasing. Follow applicable third-party agreements, including your mobile service terms. Do not copy, resell, reverse engineer or misuse the app except as applicable law or an open-source licence permits.
Your account and your data
Provide accurate account information and protect your credentials. You are responsible for activity you authorise through your account. Do not access someone else’s history, compromise security, interfere with the service or use it to monitor someone without their permission. You retain your rights in your data and permit us to process it only to operate the service as described in the Privacy Policy.
Location and Motion permissions are your choice. Background history requires the relevant permissions and settings. Uploaded history can be restored through your account, but unsynced recordings are only on your device. We cannot guarantee uninterrupted recording, complete history or recovery of unsynced information. See Support for sync, requesting a data copy and deleting your account.
Use safely
Waylit is a personal travel record. Maps, inferred places, distances and journeys may be inaccurate. Do not rely on it for emergency response, safety-critical navigation, proof of presence or legal evidence. Stay aware of your surroundings and do not use the app while driving or where doing so is unsafe.
Availability and changes
We may improve or change features and may need to interrupt the service for maintenance or security. We may restrict accounts that seriously breach these terms or the law, giving notice and an opportunity to resolve the issue where appropriate. You can stop using the service and request deletion at any time. Material changes to these terms will be notified through the service or another suitable channel before they take effect where required.
Any future paid plan will have its price, renewal and cancellation terms presented before purchase; these terms do not create a paid subscription. Mandatory consumer rights apply to any purchase and to the service.
Responsibility and your legal rights
We will provide the service with reasonable care and skill. To the extent the law allows, we do not promise that it will always be available, error-free or fit for a particular purpose. Nothing here excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be excluded or limited. Your mandatory consumer and data protection rights remain intact.
The laws of England and Wales govern these service terms, subject to mandatory protections in your country of residence. Courts of England and Wales have non-exclusive jurisdiction; consumers may also bring claims in their local courts where the law permits.
App Store provisions
The app agreement is between you and us; Apple is not a party. We are solely responsible for the app and its content, and for maintenance and support required by our agreement or law. Apple has no obligation to provide maintenance or support.
Applicable product warranties are our responsibility. If the app fails to meet an applicable warranty, you may notify Apple for a refund of any app purchase price. To the extent permitted by law, Apple has no further warranty obligations; other related claims, losses and expenses are our responsibility, subject to applicable law.
We, not Apple, are responsible for addressing any claims about the app or your use of it, including product liability, legal or regulatory compliance, consumer protection and privacy claims. We, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any intellectual property infringement claim relating to the app or your use of it. These provisions do not limit our liability beyond what the law permits.
You represent that you are not in a country subject to a US government embargo or designated by it as supporting terrorism, and are not on a US government prohibited or restricted-party list. Comply with applicable export laws and Apple’s usage rules.
Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary. If these supplementary provisions conflict with Apple’s Standard EULA, that EULA controls the App Store licence, with mandatory law taking priority.
